Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website and software services provided by Arabia Transfer, LLC, doing business as Arabia Pay ("Arabia Pay", "we", "us", or "our"), a company formed in the State of Delaware, United States. By accessing our website or using our services, you agree to these Terms. If you do not agree, do not use the website or services.
1. The services
Arabia Pay provides payment software that helps businesses sell online — including hosted checkout pages, invoicing tools, dashboards, and reporting ("Services"). Payment processing itself is performed by licensed third-party payment processors ("Processing Partners"); your use of processing services is governed by the applicable Processing Partner’s agreement, which you accept during onboarding. If there is a conflict between these Terms and a Processing Partner’s agreement, that agreement controls for the processing services it covers.
2. Eligibility and account registration
- You must be at least 18 years old and able to form a binding contract.
- You must use the Services on behalf of a lawfully operating business and provide accurate, complete registration information, keeping it up to date.
- We may require identity and business verification, and we may decline, suspend, or close accounts that fail verification or present unacceptable risk.
- You are responsible for safeguarding your account credentials, and for all activity under your account.
3. Acceptable use
You agree not to use the Services to:
- Engage in, facilitate, or fund any illegal activity, including money laundering, terrorist financing, or sanctions violations;
- Sell goods or services that are prohibited by applicable law, card network rules, or our published restricted and prohibited business categories, which form part of these Terms;
- Process transactions on behalf of undisclosed third parties;
- Misrepresent your identity, business, or products;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Services or their infrastructure.
You must also tell us before you change what you sell, who owns the business, or the website your account trades under.
4. Fees
Our software fees are described on our pricing page or in your agreement with us. Fees charged by Processing Partners for payment processing are separate, are set out in their agreements, and may be deducted by them from amounts they settle to you. We may change our software fees prospectively with notice as required by your agreement or applicable law.
5. Payment processing, settlements, and chargebacks
- Payment processing, settlement timing, reserves, and related risk controls are managed by the applicable Processing Partner under its agreement with you.
- Funds from your sales settle directly from the Processing Partner to your bank account. Arabia Pay does not hold, control, or take custody of your funds at any time.
- You are responsible to the Processing Partner for chargebacks, refunds, reversals, and associated fees related to your transactions, as set out in its agreement.
6. Compliance
You must comply with all laws applicable to your business and your use of the Services, including consumer-protection, data-protection, AML/CTF, and card network rules. You must display accurate business information to your customers, honor your refund and delivery policies, and obtain any consents required to share your customers' data with us for payment processing.
7. Intellectual property
The Services, website, and all related content — excluding your data and third-party trademarks — are owned by Arabia Pay or its licensors. We grant you a limited, non-exclusive, non-transferable license to use them as needed to receive the Services. Payment network logos displayed on this site are trademarks of their respective owners and indicate payment acceptance only.
8. Disclaimers
The website and Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
9. Limitation of liability
To the maximum extent permitted by law, Arabia Pay will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Services will not exceed the total fees you paid to us in the three (3) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Indemnification
You will indemnify and hold harmless Arabia Pay and its officers, directors, employees, and agents from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your transactions, your products or services, or your breach of these Terms.
11. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, create unacceptable risk, or where required by law or our financial partners. Sections that by their nature should survive termination (including fees owed, chargeback liability, disclaimers, limitations of liability, and indemnification) survive.
12. Complaints
Write to legal@arabia-transfer.com. We acknowledge a complaint within two business days and give a substantive answer within fifteen. If your complaint concerns payment processing, settlement, or the outcome of a dispute, we refer it to the Processing Partner responsible and tell you that we have done so. Applicants who were declined may ask for the decision to be reconsidered by a person, as set out in our Compliance page. Nothing here limits any right you have to go to a court or a regulator.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Courts located in Delaware will have exclusive jurisdiction over disputes arising from these Terms, unless your merchant agreement provides otherwise.
14. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Your continued use of the website or Services after changes take effect constitutes acceptance.
